- When a person can no longer take care of themselves, it might be time to seek a guardianship with the court. The guardian usually gains limited control of the ward’s finances and can make other decisions for their daily lives. Let’s review whether the time is right to request guardianship.
- Estate planning. Everyone over 50 should have an estate plan. You need to plan now for who will inherit your assets upon death. We use wills, trusts, and other vehicles and will help you think through your options. Avoid trying to create your own will, because it’s easy to make mistakes which render the document ineffective.
- Durable power of attorney. Our firm can create a durable power of attorney, in which you name an agent to handle your affairs. Creating this document gives you control. You choose your agent and which powers to invest them with. Without a power of attorney, you might find yourself in a guardianship proceeding, with a judge deciding these critical issues. The power of attorney is “durable,” which means it remains valid even after you become incapacitated.
- Medicaid planning. Medicaid is a government-funded health insurance for low-income Americans. Many seniors rely on Medicaid to pay for long-term nursing home care, but the program is means tested. We identify if you meet the income and asset limits. If not, we can also create a trust or other vehicle to help you qualify.
- We help our clients navigate the probate process. This is the court supervised process for administering a person’s estate after death. Many of our clients are elderly spouses named as the personal representative for their husband or wife’s estate, or a child who was named to serve in this role. Being a personal representative is a difficult job, and few people really understand their responsibilities. Let us help guide you through the legal complexities.
